1. Agreement to Terms

Welcome to Seen. These Terms of Use ("Terms") govern your access to and use of the Seen mobile application, website, and related services (collectively, the "Service"). By downloading, installing, accessing, or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use the Service.

The Service is provided by David Groomes ("we," "us," or "our"). For questions about these Terms, contact us at hello@seenbible.app.

2. Eligibility

The Seen app is rated for users ages 4 and up. However:

• Users Under 13: Children under 13 may only use the Service under the supervision and with the permission of a parent or legal guardian. Parents/guardians who allow their children to use the Service must agree to these Terms on behalf of their children.
• Users Under 18: If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
• General: By using the Service, you represent that you have the right, authority, and capacity to enter into these Terms and to abide by all the terms and conditions set forth herein.

3. Account Registration

To access certain features of the Service, you must create an account. When you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your login credentials secure and confidential
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized access or use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

4. Subscription Terms

Seen offers both free and premium subscription tiers. The following terms apply to subscriptions:

4.1 Free Tier

The free tier provides access to core Bible reading features, daily verses, and limited interactions with Abram, our AI companion.

4.2 Premium Subscription

• Billing: Premium subscriptions are billed weekly through the Apple App Store or Google Play Store
• Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the end of the current period
• Current Pricing: Weekly subscriptions are priced at $4.99/week (individual) or $8.99/week (family plan). Prices may vary by region and are subject to change
• Free Trials: We may offer free trial periods. If you do not cancel before the trial ends, you will be charged the subscription fee
• Payment: Payment will be charged to your App Store or Play Store account at confirmation of purchase

4.3 Cancellation

You may cancel your subscription at any time through your device's subscription settings:

• iOS: Settings → [Your Name] → Subscriptions → Seen
• Android: Play Store → Menu → Subscriptions → Seen

Cancellation takes effect at the end of the current billing period. You will retain access to premium features until the end of your paid period.

4.4 Refunds

Refund requests are handled by the Apple App Store or Google Play Store according to their respective policies. We do not process refunds directly. For refund assistance, please contact hello@seenbible.app and we will guide you through the process.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the Service in any way that violates any applicable federal, state, local, or international law or regulation
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service
• Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Use the Service to transmit spam, chain letters, or unsolicited communications
• Attempt to gain unauthorized access to the Service, other accounts, computer systems, or networks connected to the Service
• Use any automated means to access the Service or collect data from it (scraping, bots, etc.)
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Reverse engineer, decompile, or disassemble any portion of the Service

6. Community Guidelines

Seen includes community features such as groups, discussions, Bible studies, prayer requests, and direct messaging. When participating in community features, you agree to:

• Be Respectful: Treat other users with kindness and respect, even when you disagree
• Keep Content Appropriate: Share content that is consistent with a faith-based, family-friendly environment
• No Harassment: Do not bully, harass, threaten, or intimidate other users
• No Spam: Do not post repetitive, promotional, or off-topic content
• Protect Privacy: Do not share personal information about others without their consent
• Report Violations: Help us maintain a safe community by reporting content that violates these guidelines

We reserve the right to remove content and suspend or terminate accounts that violate these community guidelines.

7. User Content

You may submit, upload, or share content through the Service, including journal entries, notes, prayer requests, comments, and messages ("User Content"). You retain ownership of your User Content, but you grant us certain rights:

• License: You grant us a non-exclusive, worldwide, royalty-free license to use, store, display, and distribute your User Content solely for the purpose of providing and improving the Service
• Public Content: Content you post publicly (e.g., community posts, prayer requests) may be viewed by other users
• Private Content: Personal journal entries and notes remain private unless you choose to share them
• Responsibility: You are solely responsible for your User Content and the consequences of posting it

8. Abram AI Companion

Seen includes an AI companion named Abram designed to provide spiritual guidance, Scripture insights, and conversational support. By using Abram, you understand and agree that:

• Not a Substitute: Abram is not a substitute for professional counseling, therapy, medical advice, or pastoral care. For serious mental health, emotional, or spiritual crises, please seek help from qualified professionals
• AI Limitations: Abram is an artificial intelligence and may occasionally provide responses that are inaccurate, incomplete, or not applicable to your situation
• No Guarantee: While grounded in Scripture, Abram's responses represent AI-generated content, not divine revelation or authoritative biblical interpretation
• Data Usage: Conversations with Abram are processed to provide personalized responses. See our Privacy Policy for details
• Crisis Resources: If you are experiencing a mental health crisis or suicidal thoughts, please contact:

9. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of David Groomes and its licensors. This includes:

• The Seen name, logo, and branding
• App design, graphics, and user interface
• Abram AI system and personality
• Journey generation algorithms and systems
• Original written content and devotional materials

Bible Content: Scripture quotations are from the Berean Standard Bible (BSB), used in accordance with the BSB free license. The BSB is not owned by Seen.

10. Third-Party Content and Links

The Service may contain links to third-party websites, services, or content that are not owned or controlled by us. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

11. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
• WARRANTIES REGARDING THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE SERVICE

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DAVID GROOMES, ITS AFFILIATES, OR LICENSORS BE LIABLE FOR:

• ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
• ANY DAMAGES RESULTING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE
• ANY DAMAGES RESULTING FROM ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

13. Indemnification

You agree to defend, indemnify, and hold harmless David Groomes and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from:

• Your use of and access to the Service
• Your violation of any term of these Terms
• Your violation of any third-party right, including any intellectual property or privacy right
• Any User Content you submit through the Service

14. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

Upon termination:

• Your right to use the Service will immediately cease
• You may request deletion of your account data per our Privacy Policy
• All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except that you retain the right to bring individual claims in small claims court.

CLASS ACTION WAIVER: YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR OUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION.

16. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

17. Apple App Store Terms

If you downloaded the Service from the Apple App Store, the following additional terms apply:

• These Terms are between you and David Groomes only, and not with Apple Inc. ("Apple")
• Apple has no obligation to furnish any maintenance and support services with respect to the Service
• In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Service. Apple has no other warranty obligation
• Apple is not responsible for addressing any claims by you or any third party relating to the Service
• Apple is not responsible for any third-party claims that the Service infringes any intellectual property rights
• Apple and its subsidiaries are third-party beneficiaries of these Terms and will have the right to enforce them against you
